Repair Items
Service Introduction
I. Definition of Repair Items
Import and export repair items refer to goods transported into or out of the territory for maintenance and repair.
II. Main Forms of Import/Export Repair Items
1. Outbound Repair Goods – Originating from abroad, requiring export from domestic to foreign countries for repair and subsequent re-import.
2. Inbound Repair Goods – Originating from domestic, requiring import from foreign countries to domestic for repair and subsequent re-export.
III. Customs Declaration and Supervision Points for Outbound Repair Items:
1. Permit Management: No import/export license required, but statutory inspection goods require a Customs Clearance Certificate (CCC).
(1) Import/export repair items generally do not require import/export licenses, except for goods with special legal regulations.
(2) Statutory inspection goods, i.e., goods listed in the "Catalog of Import and Export Commodities Subject to Inspection and Quarantine by Entry-Exit Inspection and Quarantine Authorities," require inspection certificates for release.
2. Guarantee Application: Outbound repairs are tax-exempt; a guarantee is provided to Customs for re-import.
(1) No security deposit is levied for outbound repairs; a guarantee is provided to Customs regarding the timeframe for re-import.
3. Guarantee Period / Repair Period: Repair time is six months, extendable by half a year each time; exceeding the time limit will result in taxation.
(1) Re-import must occur within six months of export. If repairs cannot be completed within six months, an application for guarantee extension must be submitted to Customs one month in advance.
(2) If the guarantee is not extended within the stipulated time, upon re-import, the goods will be taxed according to regulations, and corresponding import permits must be obtained.
4. Quality Certificate and Old Machinery Product Filing: Quality certificate required for export; old machinery product filing required for import.
(1) For outbound repair goods export, a quality certificate issued by the Inspection Bureau or a third-party inspection agency recognized by Customs is required to prove the goods have defects needing repair.
(2) For re-import of outbound repair goods, old machinery product filing must be completed with the Inspection Bureau in advance.
5. Tax Levy: Goods are exempt from tax; repair fees are taxable.
(1) During import/export declaration of repair items, a repair agreement must be provided, specifying repair costs. When the goods are repaired abroad and re-imported, Customs will levy tariffs and VAT based on the repair costs stated in the agreement.
(2) If declared as outbound gratis repair, the original import contract must be provided upon re-import to confirm it was within the warranty period. If beyond the warranty period or if the warranty period is not stated in the original contract, even if foreign parties agree to free repair, it must be declared as paid repair (later supplemented free repair agreements are invalid). Upon re-import, taxes must be levied on the repair fees.
